Wendy Carlos deleted my video

My Tron Scherzo video, which was sequenced and played on my DS using the KORG DS-10 game, was deleted by Wendy Carlos' company "Serendip LLC".

I have now become a member of a large group of TRON fans who have had their [B]FAIR-USE TRON youtube videos taken down.

This just sucks.

What the hell are they doing? Do they seriously think I'm going to make money on selling that video or something?

I'm sorry to hear that, Mr. Sinistar. That really sucks.

I understand what's going on: the companies that hold the rights to various media forms (audio, video, both, etc.) are doing what they feel is necessary to "protect" their intellectual property. On paper, that all seems good to the company holding the rights.

In reality, what they end up doing is alienating the fans of the digital media they're trying to "protect" and also loosing a lot of free advertising in doing so.

As you may or may not know, I used real Star Wars footage in the Star Wars - The Musical videos on my website. Star Wars fans are always afraid of "George Lucas suing them" if they make any Star Wars related material. In my case, they didn't care that I used the footage. I have confirmed hits to my all of my SWTM videos from LucasFilm LTD, and never received a cease and desist notice. Perhaps that is because the videos are hosted on my own web space (as opposed to a service like YouTube) or maybe they just didn't see my SW offerings as a problem in copyright infringement because I'm not selling or profiting from it (I know you were not either).

It's really too bad that Serendip LLC has such aggressive copyright protection policies. Their legal advisers obviously don't get it. It's all about "protection" for them. They completely missed the fun-factor and free advertisement benefits your work might have brought to them.

I'm sure you know, but you're not alone here. Many companies have chosen the strict and absolute enforcement approach to "protecting" their copyrighted material. I believe this will change in time, but probably not for a while. Thank God there are some companies that DO get it and allow their fans to explore creative uses of their copyrighted material without shutting them down.

You think they're being aggressive, just look at the Hendrix estate! The only reason the Wii can't have the Jimi Hendrix DLC for Guitar Hero World Tour is because the Hendrix estate only wants them sold in a pack together, which the Wii version can't do.

Anyways, I'm sorry that got taken down Mr. Sinistar. Think of it like this: Wendy Carlos actually watched your video, thought it was REALLY good, and had it removed for that reason. Generally, only the REALLY accurate stuff gets taken down.

Just change the name. Perhaps to them it looks like you wrote it w/o giving credit to the writer. so rename it reupload it, and don't use Carlos's name.. or use a site that doesn't suck. i.e. You-Tube and Myspace, ect. I would believe it if it was a recording, but that's not even used commercially in any way. Comon. They can't charge you with anything there. It's a art form, in (most)part derived from Wendy Carlos's work called "Tron Scherzo".

I use www.vimeo.com because of problems with the other sites.

It sounds better then VGL. lol!

I mean, geez, your video was essentially an original work. You may have been playing Wendy Carlos' theme, but you were doing a new take on it.

Add to that, the fact that you're not profiting from it, and I don't really see the problem. If you'd ripped an entire track from the TRON soundtrack and posted it on a site like YouTube, then maybe I could understand. But not in this case.

I think this is a case of Wendy Carlos' music publisher, using a law firm that is being way too overzealous in their IP enforcement. They're just asking for things to be deleted outright, without even checking to see how it was used. Maybe they think it's easier to just delete anything and everything, rather than review things on a case-by-case basis.

No matter what, TheReelTodd is right when he says that what they're ending up doing, is alienating the fans. They may be doing what they think is justified according to the law, but they're handling the situation very poorly.

If people can make Star Trek and Star Wars fan videos with music from those shows and films, why can't we make Tron fan videos using Wendy Carlos' music? The TRON soundtrack has become iconic and an essential part of the TRON experience. You can't really make a TRON video, and not use some of Carlos' music. The two go hand-in-hand.
